Record Kenyan champions Gor Mahia have been fined by the Football Kenya Federation (FKF) disciplinary committee for a breach of security and failure to maintain order during their SportPesa League 25/26 opener clash against Bidco United on September 21.

The match, staged at the Moi International Sports Centre in Kasarani, saw the 21-time top-flight champions suffer their first loss of the season- a stunning 1-0 defeat courtesy of a late penalty from Newton Ochieng.

The trouble began before kickoff.

A section of Gor Mahia supporters forced their way into the stadium, citing delays at the gates.

The club had recently introduced an online ticketing system, but complications with the scanning process prompted some fans to find alternative entry, resulting in a security breach and subsequent clashes with police.

In a statement released on October 31, the committee detailed the ruling. It stated:

“The Football Kenya Federation (FKF) Disciplinary Committee has found Gor Mahia FC in violation of FKF Regulations and the CAF Disciplinary Code following a security breach that occurred during the match against Bidco United on 21 September 2025 at Kasarani Stadium.”

The statement further explained that despite Gor Mahia engaging a third party for crowd management, the club retained ultimate responsibility.

“The Committee determined that while Gor Mahia had engaged third-party vendors to manage ticketing and access control, the club retained a non-delegable duty of care to ensure safety, order, and effective supervision during official matches.

In its decision, the Committee reaffirmed that:

  • Under the Strict Liability standard, a club is responsible for incidents occurring in or around the stadium, irrespective of no fault or negligence.
  • The doctrine of Vicarious Liability extends this responsibility to acts or omissions by service providers, contractors, or other parties acting on behalf of the club.”

The committee noted that outsourcing such functions does not absolve a club of its responsibilities under CAF and FIFA disciplinary frameworks.

As a consequence, the FKF has issued a stern warning to Gor Mahia and held the club culpable for the failure to maintain adequate order and security.

The club has also been fined KSh 300,000, which must be paid within 14 days.

Despite this off-field setback, Gor Mahia are currently second in the league table with 12 points from a possible 15, having won their other four matches consecutively.

The Reasoned Decision, containing the detailed legal analysis, will be issued on 4 November 2025, upon which the club’s right of appeal shall commence as provided under the FKF Rules & Regulations (2024).
